This website, email, online forms and client portals are not emergency-response systems. Do not use them to report a life-threatening emergency or a situation requiring immediate police, fire or ambulance assistance.

Descriptions of services on this website do not guarantee that a particular service, staff member, schedule, geographic area, date or time will be available.
Service availability depends on factors such as client needs, assessment results, staffing, safety, geography, scheduling, scope of service and any legal or professional requirements that apply.
5. Client Assessments and Service Agreements
Website inquiries do not create a client relationship or guarantee acceptance for services. A service relationship begins only after EverCaring completes the required intake or assessment process and the parties agree to the applicable service arrangements.
Rates, schedules, authorized services, responsibilities, cancellation rules, payment terms and other material terms are confirmed directly with each client or authorized representative.
6. Accurate Information
Anyone submitting information through EverCaring's website, forms or portals is expected to provide information that is accurate and complete to the best of their knowledge.
Clients and representatives should promptly advise EverCaring when information relevant to service, safety, billing, contact information or legal authority changes.
7. Authorized Representatives
A person acting for a client must have appropriate authority to do so. EverCaring may request documentation or other reasonable confirmation of authority before accepting instructions, releasing confidential information or making material changes to services.
8. Website Accounts and Portal Access
Where EverCaring provides a client, staff or administrative portal, access is personal to the authorized user. Users must protect usernames, passwords, access links and authentication credentials.
Users must not:
- share credentials with unauthorized persons;
- attempt to access another person's account or records;
- bypass security controls or access restrictions;
- use automated tools to probe, scrape or disrupt protected areas;
- upload malware, harmful code or material intended to interfere with EverCaring systems.
9. Acceptable Use
The website and online systems must not be used to:
- commit fraud or misrepresent identity or authority;
- harass, threaten, intimidate or abuse clients, staff or other users;
- publish or transmit unlawful, defamatory or malicious content;
- attempt unauthorized access to records, systems or accounts;
- interfere with the operation, availability or security of the website;
- copy, exploit or misuse confidential information obtained through an EverCaring system.
10. Privacy and Confidentiality
Personal information submitted through EverCaring's website or online services is handled in accordance with EverCaring's Privacy Policy and applicable privacy requirements.
Users must respect the privacy and confidentiality of others and must not disclose information obtained through an EverCaring portal or communication unless authorized to do so.

11. Payments and Billing
Where online payment options are available, card payments are processed through an approved payment processor. Payment information, invoices, receipts, balances and adjustments remain subject to the applicable client service agreement and billing records.
A website payment confirmation does not override a corrected invoice, lawful refund, chargeback, failed payment, disputed transaction or other adjustment supported by the payment processor or EverCaring's accounting records.
12. Cancellations and Missed Services
Website content does not replace the cancellation, missed-visit or service-termination terms agreed with a client. Any applicable notice periods, fees, exceptions or service transition requirements are governed by the client's actual service agreement and EverCaring policies.
13. Safety and Right to Refuse Unsafe Service
EverCaring may decline, pause, modify or end a service when there is an immediate or material safety concern, including violence, threats, harassment, uncontrolled animals, unsafe equipment, environmental hazards, smoking or oxygen risks, illegal activity or any situation in which staff cannot reasonably provide care safely.
Any decision affecting ongoing client service will be handled according to the applicable service agreement, safety procedures and legal obligations.
14. Respectful Conduct
EverCaring is committed to respectful treatment of clients, families, staff and visitors. Abuse, discrimination, harassment, bullying, threats, intimidation, exploitation or violence toward any person involved with EverCaring is not acceptable.
15. Staff Scope and Professional Boundaries
EverCaring staff may only perform services that are authorized, lawful and within their role, training, competence and the applicable care or service plan.
Website descriptions must not be interpreted as authorizing a worker to perform a controlled act, regulated professional service, medication activity, transfer, lift or other task outside the worker's permitted scope.
16. Third-Party Services and Links
The website may contain links to third-party websites, payment services, mapping services or other external resources. A link does not mean EverCaring controls or guarantees the external service.
Third-party websites and services are governed by their own terms, privacy practices, availability and security controls.
17. Intellectual Property
Unless otherwise stated, the EverCaring name, website content, written materials, graphics, forms, branding, policies and other original materials displayed on this website are owned by or used with authorization by EverCaring Home Care Services.
Content may not be copied, republished, sold, altered, distributed or commercially exploited without permission, except where permitted by law.
18. Website Availability and Technical Issues
EverCaring works to maintain reliable website and portal access but does not guarantee uninterrupted availability. Access may be affected by maintenance, hosting issues, software updates, internet outages, cybersecurity events, third-party services or circumstances outside EverCaring's reasonable control.

EverCaring uses reasonable safeguards to protect its online systems. However, no internet-based service can be guaranteed to be completely free from security risk.
Users who believe an account, password, message, document or portal may have been compromised should contact EverCaring promptly.
20. No Guarantee of Outcomes
EverCaring does not guarantee a particular health, personal, financial or service outcome from the use of its website or from general information presented online.
Actual services are based on the client's individual circumstances, agreed service plan, authorized tasks and ongoing assessment.
21. Limitation of Website Liability
To the extent permitted by applicable law, EverCaring is not responsible for losses arising solely from reliance on general website information, temporary website unavailability, third-party websites, unauthorized account use caused by a user's failure to protect credentials, or information submitted inaccurately by a user.
Nothing in these Terms excludes or limits responsibility that cannot lawfully be excluded or limited.
22. Indemnity for Misuse
To the extent permitted by law, a person who deliberately misuses EverCaring systems, submits fraudulent information, violates another person's rights or causes loss through unauthorized or unlawful activity may be responsible for resulting losses, claims or costs.
23. Suspension or Termination of Online Access
EverCaring may suspend or terminate portal or website account access where reasonably necessary to protect security, privacy, clients, staff, records or systems, or where an account is being used in violation of these Terms.
24. Changes to These Terms
EverCaring may update these Terms when services, technology, legal requirements or business practices change. The current version posted on this website will identify its effective date.
25. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. Any provision found to be unenforceable will be limited or severed only to the extent necessary, and the remaining provisions will continue to apply.
